Senator Crystal Diamond Responds to Draft Supreme Court Opinion on Roe v. Wade
SANTA FE – Late yesterday, Politico reported that a leaked draft of an opinion in Dobbs v. Jackson Women’s Health Organization, written by Justice Samuel Alito, indicates that the U.S. Supreme Court is poised to overturn Roe v. Wade. The decision would send the legality of abortion back to lawmakers at the state level.
If the Court overturns Roe, New Mexico state law would govern abortion access in the state. Senate Bill 10, passed in 2021 and signed into law by Governor Michelle Lujan Grisham, repealed the state’s abortion law, so New Mexico would remain one of many states where abortion would remain legal.
Senator Crystal Diamond (District 35-Doña Ana, Hidalgo, Luna, and Sierra) released the following statement regarding the leaked opinion:
“The thin legal standing of Roe has been well-documented and it is long overdue for the U.S. Supreme Court to correct this erroneous decision. At the same time, even if the opinion and report are legitimate, New Mexico will maintain its status as the abortion capital of the country.”
“As it stands, minor girls can obtain abortions without any parental notification and an unborn child can be legally aborted for any reason right up until birth. It breaks my heart that women from near and far will come to our beloved state for the sole purpose of ending their pregnancies.”
“As New Mexicans, we can no longer shirk our duty to stand on this issue. We must address it with compassion for women without compromising our ultimate duty to defend the life of the innocent. I hope and pray that a majority of the Justices have the fortitude to stand by this decision so our nation can heal and move forward in a post-Roe culture that cherishes human life at every stage.”
